And What if Trump Wins Again?

 

President Trump has been in a war since even before the votes making him President were finished being counted. As soon as he was declared the winner of the election, he began being attacked with a greater fury. Donald Trump as a candidate based his appeal on his intent to “Drain the Swamp.” Needless to point out, the swamp does not desire draining. The swamp has a multitude of weapons at its disposal as well as numerous allies in Congress, the media and throughout the government. One item which need be explained, the government is not the swamp and the swamp is not the government. The swamp is the upper management of the government and selected middle management who desire gaining entrance into the swamp as new blood is always required in order to replace the old who retire and to feed the swamp enlarging its size, scope, reach and power. There are numerous theories over when and where the swamp was born. It is obvious how it grew. The swamp gained size inadvertently as the government expanded and at some point it became self-aware, some in the upper echelons of the government realized that their reach and orders were beyond the dictation and direct supervision of Congress. They realized that they only needed to answer to one another and once they attained sufficient control in the various departments, they began to run the government independent of any supervision as long as they were careful and moved deliberately and slowly. So, let us make some conjectures as to when and how the swamp became self-aware and then grew to the unwieldy size it has reached currently.

 

The initial references to the swamp came likely earlier than most think and from what they would call an unlikely source. It was on January 17, 1961, during his parting national address when President Dwight David Eisenhower stated, “In the councils of government, we must guard against the acquisition of unwarranted influence, whether sought or unsought, by the military-industrial complex. The potential for the disastrous rise of misplaced power exists and will persist.” President Eisenhower realized the threat to the American people of having control over their own governance being taken away from them. President Eisenhower also warned of a “scientific technological elite” becoming so powerful that it gains control over public policy. The entirety of President Eisenhower’s farewell address which is one of the most prescient such speeches since the historic and venerated parting address by President George Washington. President Eisenhower knew exactly of what he spoke due to his service as the Commanding General of Allied Forces in Europe during World War II where he saw first hand the scope, power and potential of the efforts which supported the allies. He sat in the catbird seat overseeing the manufacturing power and logistics supporting the war effort and realized that much of what was done was not fully supervised and only the general directives of needs simply generated almost automatically the required manufacture of exactly what was required. General Eisenhower oversaw the return to civilian control and manufacturing after the war before running for President where he once again sat overviewing the government side of the winding down of the military and government entanglement. What he witnessed obviously gave him pause leading him to the farewell address including numerous warnings, as he did not desire going into retirement without sharing his insights of the coming dangers. Unfortunately, President Eisenhower, the culmination of his military career which reached the highest rank of Five Star General before becoming Commander in Chief and despite his timely warning, the swamp, the result of the military-industrial complex, still rose from the over-bloated government just as he had feared.

 

 

Moving ahead slightly more than half a century, the American people elected an aging real estate mogul who is brash, impolite, self-absorbed, egotistical and some might add maniacal, unbalanced, crude, rude and completely politically incorrect. He is known as President Donald Trump and from what can be measured, either you love him or you abhorrently revile him. Social media has never been so politically active with one group calling the President every pejorative in the book and even making up a few additional ones while sharing every claim of his misspeaking, taking a misstep, acting boorishly, slighting people for the wrong reasons, being a racist, homophobic, sexist, Islamophobic, xenophobic, misogynistic, arrogant fool who is out to destroy the planet through ecological damage allowing climate change to run wild. And they might claim that these are his good points. Then there are those who love President Trump and relish his every victory as he bests all comers often one at a time while at others in broad swipes sweeping numerous of his insulters with one broad-brush stroke. Those who despise him find nothing of merit no matter his accomplishments while his supporters are rarely put off by his often-stinging rebukes and missteps. His haters look at what he says ignoring his accomplishments while his supporters ignore much of what he tweets and bathe in the warm light of his accomplishments. This is why there can be two so opposite camps whom between them there is not a single agreement.

 

The claims that the United States has never appeared so divided are valid but the arguments that the United States has never been so divided are quite false. Taking those who absolutely despise President Trump and many of these were so enamored over President Obama that they never saw anything he did as having any bad consequences while most who find President Trump so appealing and merit him with great achievements found President Obama as a walking catastrophe who appeared to work to the detriment of the nation with his every effort. Simply stated, the United States were just as divided under President Obama as they are under President Trump with a minority who found both men at the very least, sufficiently palatable to give their vote. Many will claim President Trump only won because Hillary Clinton ran a poor campaign, frightened voters away or the Russians interfered because they desired to make Trump President because they had some deal. Many claim that President Trump is an anomaly who has no chance of ever being reelected to a second term. Many others point to the hope that President Trump is about to be charged with heinous crimes by Special Council Mueller. Finally, some supporters believe President Trump will prove to be a decent President and will be easily reelected. This final group claim that getting the tax cuts approved will very probably assure President Trump being reelected as people vote their pocketbooks. What if this final group is correct, would a second term make any difference in President Trump fighting the Deep State and actually fulfill his promise to drain the swamp?

There is one thing which, if completed, would make all in America better off, if President Trump can actually drain the swamp. Begrudgingly or with glee, one must give President Trump credit for revealing the biases and misrepresentations which plague the American and world medias. Despite the game being thrown open for all the public to witness, there are those who refuse to take note, as they prefer the beguiling sweet tunes where untruths are sweetly spread to actually thinking independently and making decisions themselves. Thinking is apparently something which too many find just requiring far too much efforts and actual thinking. These are the people who read the New York Times or other leftist rags, including but not limited to the Washington Post, Los Angeles Times, the Philadelphia Inquirer and many others with at least one in every major city, in order to find what to think and how to vote. Then there are those from the other side who read papers such as the Wall Street Journal, Las Vegas Review-Journal and a very small collection of other newspapers supporting President Trump. President Trump did mange the media and its combined hatreds of him to his advantage using them for publicity following the adage that any media is good media and the more the merrier. The liberal media and their hatred was played by Trump to get his campaign coverage where he would invite invectives as long as they also carried his message of power taxes, less regulations, smaller government and most of all his themes of America First and Make America Great Again. This little game he played throughout the primary campaign as he took out one Republican contender after the other until he won and then again in the campaign for President where he used their vile hatred to also carry his message to the people.

 

The one direction which holds any means for President Trump to be reelected will be to deliver on his promises in such a large and obvious way as to be seen unavoidably. President Trump will need to gather voters from two very important groups beyond holding on to those who voted for him the first time. He will need to pull some voters from those who could not find their way to vote for him or Hillary Clinton and either remained home or voted third party. He will also need to win the votes, and these will be the most difficult, from people who decided to vote for Hillary Clinton because they found Trump far too unacceptable for them to cast their votes. Finally, he may also require some votes from people who actively voted for Hillary Clinton for whatever reason. Plainly explained, President Trump will be required to win so convincingly that there can be absolutely no doubt of his victory.

That is another of the items which has become evident with the election of President Trump, American elections are not fair and cheating and voter fraud being rampant. We have been fed claims by the corrupted media that the elections in the United States are above any fraud and irregularities. The media in the past managed to disregard small irregularities such as reported in Judicial Review. There are a few ways by which President Trump can win a second term. They all will require that he win by a convincing tally in enough states, the same as he won last time, and thus retain the Electoral College victory. Such a victory could be made far easier should the Democrat Party run a candidate as poorly chosen as the last elections. There has been talk of Oprah running in 2020 on the Democrat ticket. Such a pair matched in a Presidential debate, Oprah and the Donald, who could ask for better folly? Then both Hillary Clinton and John Kerry have hinted at their considering a run which I am sure President Trump would welcome. There are so many others but the one who is the main hope of the Democrat Party just had his going out party giving the response to the SOTU address, Representative Joe Kennedy III from Massachusetts (which we critiqued here). His hopes started with his speech the other night and the responses to it have been as expected with much of the media drooling over the possibility of renewing the Kennedy dynasty while others will find great fault claiming his performance was completely lacking in some vitality or presence. Whichever you subscribe to, be prepared for much more from him in the coming years including possibly reaching for the governorship of Massachusetts. Then again, President Trump might just decide he does not desire a second term, though such is highly unlikely.

Democracy’s Greatest Threat Wrapped in Black

 

A black robed figure often represents the Angel of Death or can represent a corrupted soul. As such a figure, it could be used to represent a select group of people who have powers greater than the Congress, the Administration or even the “Deep State,” and one who is unafraid to use its powers. Such a figure could even oppose a President and nullify any action he tried to take. They could completely alter the definitions and intentions of any legislation after it has been passed and signed into law. They could have people taken and held incommunicado for as long as they deemed necessary. In their own opinions and rulings, their powers would be unlimited and could not be denied, opposed, weakened or otherwise moderated by anyone in the government and they would not answer except to others of their own kind. Such are the Federal Judiciary of the Justice Department, the police, law enforcement and special officers who can have arrest, detain or otherwise serve writs as instructed by the Judiciary. Their powers can be enforced by the Attorney General, the BATFE (Bureau of Alcohol, Tobacco, Firearms and Explosives), FBI, ICE (Immigration and Customs Enforcement), IRS and the remainder of the various law enforcement agencies under the DHS (Department of Homeland Security). The actual individuals we are referencing are the Judges themselves, specifically the Federal Judges.

 

Relatively recently there were two Federal Judges, one in Hawaii and one in Maryland (no surprise) who annulled a directive to the Immigration Department to restrict immigrants from the same six nations which had been named for special considerations by both President George W. Bush and President Obama. The order was to last approximately ninety days or until sufficient methods were put in place for vetting immigrants from these nations. All of the nations have no actual effective governance and no method for identification of their people and are nesting homes for terrorist groups. Both of these judges, United States District Judge Theodore Chuang and United States District Judge Derrick Watson, were both surprisingly, or not, appointed by President Barack Obama. Judges have found rights in the Constitution which have baffled Constitutional scholars as well as us. Who knew that James Madison intended that bakers must bake a cake as fast as they can for anybody no matter how much of an offense to the baker the cake’s intended celebration may be. You are a devout Christian and a baker and a same sex couple would like a specially designed wedding cake and you must bake it or be sued and lose your business. Why wouldn’t a judge not simply order the couple to go and use another baker, who is not so undisposed to desire their business, instead of seeking out a baker who has Bibles on the shelves of his shop and then try and force them to make their cake. We are willing to bet that had one of the pair requested a wedding cake and stated they would add the couple atop the cake later, as they had a special family heirloom they would use and would bring it out at the ceremony, that they would have their cake already as long as they had not eaten it. But common sense, in many ways, has appeared to have left the building in disgust never to return. And this problem goes beyond court decisions and appears to have spread to the general population across the planet.

 

Judges out of control is not merely a problem in the United States. This is also a big problem in Israel. The originating source of the problem comes from the words of Israeli Supreme Court former Chief Justice Israeli Aharon Barak’s in his statement that “everything is justiciable” which has led to serious threats to the Israeli governance. Fortunately, Justice Minister Ayelet Shaked is challenging the broad application (pictured below) which had become a major disruption as the Supreme Court has utilized this to dangerously overstep their powers believing they wield unchallengeable powers. This one statement was made, as a justification for the Supreme Court in particular, and judges generally, to take the extra step to right those things they see as wrong. They are to be the final arbiters of everything in Israeli society, life, governing and even military decisions. The Israeli Supreme Court has nullified laws which were passed by the Knesset and approved by the Prime Minister, in some cases more than once. The Israeli Supreme Court altered the route of the Security Barrier which placed some additional Israelis in direct threat of added terror threats. The Israeli Supreme Court has ordered homes in the disputed territories destroyed without ever demanding proof of Arab ownership and even without questioning or meeting the Arab presumed to have owned the land and simply as a response to charges raised by anti-Zionist NGO’s. The Israeli Supreme Courts countermanded orders during the Gaza and Second Lebanon Wars and also in peace times. The Israeli Supreme Court has enacted laws they believed were necessary without any action by the Knesset or Prime Minister and in all of these cases, the Supreme Court refused to admit that these powers were beyond their delineated powers quoting former Chief Justice Aharon Barak’s “everything is justiciable” statement. Rounding up the Israeli Supreme Court expanded powers which were self-declared is something vital for the survival of the Israeli democratic governance. The Supreme Court cannot claim and actually wield such that their power is unopposable and spans placing them over all other branches of government and even over the generals and officers of the military. The Legislative Branch, the Knesset, and the Prime Minister’s Office and Cabinet cannot function to implement the will of the people if the Supreme Court, which we will explain why it does not represent the people and is getting further from the people every day, can overrule every vote, rescind every law, veto every decision and even enact whatever laws they see fit thus making the Knesset and Prime Minister all but irrelevant. Everything stated about the Knesset and Prime Minister goes double for the military which cannot have a court, even a Supreme Court, second guessing officers and their orders during a war as that gets people’s children killed. The Israeli Supreme Court has overruled Ministers in the Cabinet’s funding decisions when they displease the sensitivities of one of the Justices. What a way to run a country.

The Israeli Supreme Court chooses its new Justices when a vacancy is made in a way which is unique in the entire world. First is the method for determining the Chief Justice and Deputy Chief Justice which is done by simple seniority, the longest serving judges on the court are appointed to the Chief Justice and Deputy Chief Justice positions. Replacing a retiring Justice on the Supreme Court is performed by a nine-member commission. The selection of the members of the commission guarantees that the Israeli Supreme Court almost never varies from the positions taken by the founding justices in the early 1950’s. The Judicial Selection Committee is a nine-member committee with the members selected as follows:

Justice Minister – Chairman.
Cabinet Minister, chosen by the Cabinet.
Two Knesset Members, (one member from the coalition and one from the opposition).
Two members of the Bar Association (selected by the two largest factions).

With the two Supreme Court Justices plus the Chief Justice of the Supreme Court and two members from the Bar Association who will likely have to represent people or groups in trials before the Supreme Court there are five people who are obliged to curry favor with the existing Supreme Court or are members of said Supreme Court. That is five out of the nine-member committee and thus a majority. Simple math shows rather quickly, as to why the Israeli Supreme Court seldom has a Justice placed on the bench which is any different in their politics from the existing members on the Supreme Court. While the Israeli public and governance has changed significantly over the years as Israel has grown from being an agrarian economy with a GDP of $2.6 Billion in 1960 which became $6.3 Billion in 1970 climbing to $21.9 Billion in 1980 then taking off to $52.5 Billion in 1990 continuing to rise to $132.4 Billion in 2000 then jumping to $233.7 Billion in 2010 finally reaching $318.7 Billion last year in 2016 and an advanced economy leading the world in many computer, medical, agricultural and other scientific areas of excellence (see graph below). This change from an agrarian economy to one centered inside cities largely surrounding Tel Aviv with an active and admirable high tech core plus making advances in medicine, new drugs, treatments as well as an active energy economic segment which includes ecological imperatives for clean energy, Israel has changed remarkably. She has also changed politically becoming more Zionist and the religious core has broadened and continues to grow. Unfortunately, this has not been represented by the Supreme Court which has the same socialist leftist beliefs at its core as it did in 1960.

Courts which overstep the presumed limits were a fear expressed by the Founding Fathers; so we will close with some quotes.

We have concluded that Thomas Jefferson had as great a fear of the Judiciary as we have developed and for this reason, as well as others, we really love Thomas Jefferson.
