Israeli Laws and Disputed Territories

 

The term “Disputed Territories” while more accurate than “Occupied Territories” is still not exact enough to relate the truth and the actual state of these areas under International Law. Because of treaties, conferences et al including but not limited to (and with apologies to our regular readers but the list once again) San Remo Conference, Treaty of Sèvres, Treaty of Lausanne, the Mandates System and the Treaty of Westphalia (which defines the necessary requirements an area must meet to be denoted as a State). Still, we will use the term “Disputed Territories” for this article unless referring to specific regions or a change in recognition of the existing dispute.

 

All of the treaties listed above lead to one singular conclusion, under International Law, the eastern border of the State of Israel is the Jordan River. There is but one way that such can be altered, and this is what is attempting to be forced down Israel’s throat, Israel must release claim to the lands and actually grant that right to another entity. This is what actually occurred with Gaza as Israel, under the near despotic acts by Prime Minister Ariel Sharon, did legally transfer the rights to govern Gaza as a separate entity to the Palestinian Authority. This legally gave the Palestinian Authority an actual piece of land with which to prove they could run an actual nation. When the Palestinian Authority lost these gifted lands to Hamas, Islamic Jihad and other criminal and terrorist entities, they proved that they were incapable of ruling over the people they claimed were loyal citizens and these loyal citizens proved they support terror and the destruction of Israel over having a state of their own. They also negated the conditions under which the land was forfeit by Israel, which allows Israel to rescind their let of claim and retake the Gaza area. But Israel, like Egypt, wants nothing to do with Gaza, as its residents are largely terrorists and their supporters whose goal in life is dead Israelis and the Jewish State in smoldering ruins with not one shred of evidence the Jews had returned. So Gaza is currently an illegal entity run by terrorists.

 

The sad part is Gaza is not all that different from the areas in the Disputed Territories run by the Palestinian Authority. The reason we gave this introduction is that the Likud Party Central Committee just voted, according to reports and the Likud’s press release, unanimously to extend Israeli Law to the Jewish communities within the “Disputed Territories” and those areas under total Israeli control. That would include Area C which, according to the Oslo Accords, is under Israeli civil, security and military control and forbidden to construct within or otherwise attempt to extend any legal control over parts by the Palestinian and other Arab Palestinian entities. This would include the building of inferior quality and sometimes even dangerous homes and shops by the European Union (EU) marking them as intended for the sole use of the Palestinian People establishing these areas as part of what the EU considers the State of Palestine. Israel has destroyed numerous of these types of villages as they are more than structural threats and politically threatening to Israel, these structures are substandard, have no running water, no sewage with bathrooms simply emptying into pits contaminating ground water, no electricity, no utilities and are lacking any compliance with building codes allowing for the potential for disease and other horrific results if permitted to be used and inhabited. Jewish structures built with power and utilities but which were considered substandard have also been routinely destroyed by Israel, something the media refuses to recognize telling only when these EU structures or other Arab illegal places are taken down. The reporting has been definitively one-sided against Israel, especially in Europe and in the left-wing media in the United States.

 

As we mentioned at the start, the Likud Central Committee has just voted unanimously to extend Israeli Law to the communities and state owned areas in Area C replacing military rule. The main change would be that instead of criminal acts being investigated by the military authorities, they would be investigated by civilian law enforcement with military assistance if requested, and instead of trials taking place in military courts, civilian courts will be used. This is being touted as a remarkable first step in a process and that the Likud is breaking new ground. There is a small problem with the Likud claim, the Jewish Home (HaBayit HaYehudi הַבַּיִת הַיְהוּדִי) has not only been a proponent calling for this for years, their members in the Knesset have taken steps in an effort to effect this exact change. Justice Minister Ayelet Shaked in May of 2016 made calls to revive an initiative that would extend Israeli civil law to Jewish communities in the West Bank.

The original bill which Justice Minister Ayelet Shaked was attempting to revive was introduced and in 2014 was sponsored at that time by MKs Yariv Levin (Likud) and Orit Strock (Jewish Home), who stated that the legislation “will protect the rights and obligations of all Israelis in Judea and Samaria. There is no justifiable reason why Israeli citizens living in Judea and Samaria are unable to self-determine rights and obligations through the representatives they elected to the Knesset for this purpose, without applying sovereignty to the territory.” Prime Minister Netanyahu (Likud) did not make this legislation something he would hold coalition members to vote to support. That was a political move so as not to anger certain members of his coalition.

This has also been the unfortunate position of Prime Minister Netanyahu on this subject as if he is worried what will the world, Europe in particular, think if we change even the slightest of the present imbroglio Israel has allowed be woven since the passing of the Oslo Accords. The telling thing, also in article, is that Netanyahu did not even insist that his party members support the bill. We have long suspected that Prime Minister Netanyahu is more worried with his image and likability in Europe and the other countries of the world and often this makes him too hesitant to do what is inevitably necessary. The longer Israel waits to do what will be found to be necessary, the more the world will condemn Israel. It may already be too late but if not, then the time is passing before our eyes and is being wasted. The Likud Central Committee vote to support extending Jewish Israeli civil law to the communities in the Shomron is a decent restart. The only problem is that the vote is not binding on the Likud Knesset members and we can bet that Prime Minister Netanyahu will make a definitive point that he is not beholden to the vote and will not force anyone else to back such legislation.

 

The Regulation Bill, a revolution that paves the way for Israeli annexation of Judea and Samaria, was championed by Jewish Home Party Chairman Naftali Bennett when it was introduced in December of 2016. This was another piece of legislation which was to normalize the Jewish communities in the Shomron with the rest of Israel sponsored, or at the least co-sponsored, by Jewish Home Party as a whole which passed the Knesset in February of 2017. The Supreme Court has not struck down this law thus avoiding a battle with the Knesset where many ministers had threatened to clip the wings of the Supreme Court if it should continue to believe they had veto power and were to examine every piece of legislation and decide on its meaning and even its validity. So, at least thus far, the Regulation Bill remains intact and passed.

The Likud Party and their support would be required for getting legislation enforcing the concept passed unanimously by their Central Committee. Despite what the media will come out and report or what Likud members in their excited, grab attention state will scream proudly into the closest microphone, this is far from a new concept and they are grabbing the thunder as the Justice Minister, Ayelet Shaked of the Jewish Home Party, is already working to revitalize former legislation which proposed exactly this idea. Her efforts may have come as members of the Likud Party told her of their Central Committee coming support and thus she knew that the right time was approaching. Ayelet Shaked has championed this cause which was partially why she was tapped to be Justice Minister by Naftali Bennett and the hierarchy of the Jewish Home Party. She has also done a great amount of work making necessary adjustments to the way Justices and Judges are selected and balanced the Israeli adjudicators such that they now represent a wide variety of political attitudes, as they were rather one-sided when she took on being Justice Minister. She has been lauded as one of the best Justice Ministers as she has quietly and with minimal feather ruffling managed to radically alter much of the judicial problems that have plagued Israel for the past fifty years. It is not unusual for Likud to hold off supporting numerous Jewish Home Party proffered legislations simply to introduce a near identical legislation with great fanfare claiming that this will be remembered as a momentous day in Israeli legislative history. Well, if they had played straight, then that momentous day could have come earlier but doing so would have meant sharing the spotlight, and politicians do hate sharing the spotlight almost as much as others get steamed over others stealing their spotlight. But for those who watch and follow the Knesset realize, much of the groundbreaking legislation others put forth were originally ideas which came from Jewish Home Party, the party which represents religious Zionism and is a proudly conservative, Jewish, Zionist party with a bright future.

Yair Lapid and Avi Gabbay Show True Colors

 

Yair Lapid and Avi Gabbay each revealed their real positions and declared war on all religious, nationalist, Zionist and Conservative or right-leaning voters and the work done by the Knesset to legally pass legislation. They claim they will use the courts and all other means at their disposal in thwarting the will of the people. Their actions are simply an extension of their mutual belief that only they possess true sight and that makes their opinions more correct and necessary than that of the voters. Their inability to accept the will of the majority simple reveals their own self-derived greater-than-life image of themselves as the true prophets of our times who have been chosen by Heaven to intervene and make the government upright again. If only they actually had such insight, but alas, they only possess self-righteous pride and the belief that they know better and we must accept their wisdom or else they will go to any length to defeat our triumphs and overturn our accomplishments. Let us recount each of these gentlemen’s latest announced crusades and the revelations they provide.

 

Let us take the more reasonable Avi Gabbay who at least claims he will use legislative means to accomplish his quest. Mr. Gabbay was kind enough to spell everything out for us when he stated, “December 27 is a dark day in the history of the fight against crime and corruption. I reiterate my commitment: The government which I will head will abolish the Recommendations Law, the Supermarket Law and the Job Law.” Well, there it is. If the people of Israel would simply realize the opportunity facing them and place their trust in the Zionist Union, then they would do their best to undo everything accomplished in the past year’s efforts. You like being a Jew and think that the religion should be the basis for attitudes of the government, then Avi Gabbay is not your man. If you believe that laws need to be made by the Legislature, interpreted by Judges and merely enforced by the police, then Avi Gabbay is not your man. The simple truth from Mr. Gabbay is that he desires an Israel which is democratic and multicultural with perhaps a touch of Judaism permitted in certain neighborhoods. His vision is known as a Secular Israel where Israel is the Middle East version of the United States and he is the Barack Obama, Hillary Clinton, Chuck Schumer and friends modern Democrat Party where the Zionist Union are the Democrats working for that brave new world where the government is supreme. They also have a problem fulfilling their party’s name, Zionist Union. They have the Union part down pat if they are referring to Union as in Soviet Union as they love all things leftist but they are not all that much Zionist. They believe that the Arabs have just as much right as the Jews to the land and the Arab claim is just as historically valid as the Jewish claim. We have to wonder if Avi Gabbay was at all impressed and pleased with President Trump’s announced recognition of Jerusalem as the Capital City of the nation of Israel or would he prefer Israel moving the capital to Tel Aviv where the embassies still sit. What is the difference and why are those religious types making such a fuss, we can almost hear them asking. It has to do with the history of the Israelites and all of the generations of the Jewish people for the past three-thousand years plus. But what is the big deal, Avi just does not get it.

 

Now for Yair Lapid and his cry that every last one of the hundreds of reservations brought forward against the bill, many by his party, were being voted down one after the other, that should the Knesset pass the Recommendations Law, his party will challenge the law hoping to get it annulled by the Israel Supreme Court. This law, according to Arutz Sheva states, “According to the coalition’s conclusions, the law will only relate to the non-publication of police recommendations in the media, and will determine that in investigations in which there is an accompanying attorney, there will be no recommendation but only a summary of the hearing.” Yair Lapid recently stated that he should be considered to be the next in line for the Prime Minister position as he is the logical extension of Benyamin Netanyahu as he, Yair Lapid, is just as conservative, just as religious, just as strong a Zionist and simply more Bibi than Bibi. Apparently, the more Bibi than Bibi opposes the actual Bibi who supported the passing of the Recommendations Law and Yair ‘I’m more Bibi than Bibi’ Lapid will go to the Supreme Court demanding that they overturn the legislation immediately once it has passed, or at least some time convenient after he wakes and gets a good breakfast under his belt, then Supreme Court must act as Yair Lapid has spoken.

 

Both of these politicians suffer from a severe misreading of the Israeli public as they believe in their post-Zionist views and their anti-religious pro-governance by autocrats and the Black Robed Dictatorial Courts. We discussed this concept and its birth and continued applications and the ramifications in greater depth in Democracy’s Greatest Threat Wrapped in Black and how the current Israeli Coalition, led by Justice Minister Ayelet Shaked, has worked to change the self-replicating appointment methods of judges, particularly Supreme Court Judges, and lessen the power and range of adjudicable subjects to coral the runaway power extension and liberties taken by the Supreme Court. Their days of overturning laws passed by the Knesset, reversing decisions made by the Prime Minister, authoring laws they believe are necessary to advance society in the “correct” direction, and even countermand orders given by command level officers of the IDF during a conflict. The Israeli Supreme Court has long worked under the concept put forth by Israeli Supreme Court former Chief Justice Israeli Aharon Barak in his statement that “everything is justiciable” granting the Supreme Court and all courts unlimited power. Yair Lapid hopes to use their power to once again impose the leftist views of the court, and Yair Lapid, upon the nation overturning legislation passed by the Legislature. Yair Lapid, a former editorial newscaster who was famous for reporting the news as he saw the news. He used his name identification and popularity gained from reading the teleprompter and having good writers with whom he likely had a working relationship.

One thing we will give Yair Lapid credit, he can read a teleprompter with the best of them, sounds smooth, and presents well. He can tell you exactly what you should want and then convince you to vote for him to get it. Unfortunately, Mr. Lapid is most often simply reading a script constructed to make him sound exactly what the audience to whom he is speaking wants to hear and are willing to but unchallenged. To Zionists, he sounds as nationalist and pro building in the Shomron sounding like Naftali Bennett with just sufficient Bibi and a small amount of safe centrist pabulum making him too good to be true. To the secular post-Zionists, he does not even need speechwriters, as this is what he actually believes. The secular Israel is a Democracy first, second, last and everything inbetween with Judaism simply one of the plethora of religions observed here. Yair Lapid was once a proud two-state solution water carrier who believed that if Israel just found the perfect combination of land and other incentivizes then peace would be reached and the terrorism would end and everything will be perfect. One can only wonder how far from his roots he has managed to move. He claims he can out Bibi, Bibi, and can almost match Bennett but his idea is to be more logical and able to compromise where required to get the most, yet he spoke as a supporter of the Gaza pull-out. Not all that long ago, right before the last elections, Mr. Lapid stated, in clear English, “The details may be complex, but the basic idea is simple – Israel doesn’t want to absorb 3.5 million Palestinians. It is time to separate and guarantee our future as a Jewish and democratic state.” One must believe now that he is a Zionist’s Zionist? Really now, why are we having problems believing this. Of course, he can also out Gabbay, Gabbay, when speaking to the left wing demonstrators in Tel Aviv. He is the perfect politician capable of being whatever the crowd wants to hear and he counts on his true friends in the media to cover his chameleon-like presentations molding his speeches to each crowd.

The next Israeli election is going to be so much fun for us as politicians attempt to assure their leftist base that they really do not mean most of what they are having said in the media as everyone attempts to out Bibi, Bibi except for Bibi who will be attempting to out Bennett, Bennett. Unless something changes within Beit Yehudi (Jewish Home), then Naftali Bennett will run believing his time has come. The one big problem standing between Bennett from a fair chance at making it to the top spot is Bibi. Should Bibi step aside, then Likud, with a large assist from Netanyahu, needs to groom the next seemingly permanent Prime Minister and do so fast. Netanyahu has so efficiently prevented anyone challenging his position at the top of the party that there has not developed a successor. Without Netanyahu or a strong Likud candidate, then the field will be open and then who knows what will come next. The one person who would make a formidable candidate for Likud might not desire the top spot, Tzipi Hotovely. Some day Israel might face two women running for Prime Minister with Tzipi Hotovely for Likud and Ayelet Shaked for Jewish Home, now that would be a real choice of two of the most competent and complete candidates who would, either of them, make for a strong and well represented Israeli Prime Minister. That would be the political race the world would watch. For now, we are going to have to settle for the biggest question of the moment, will or will not Bibi Netanyahu run at the head of Likud, and if not, then who? Then there is another less tempting question, who will be the candidate to lead Zionist Union? Will it be Avi Gabbay or will it be Ehud Barak? Beyond these questions, there are some other side items such as who will be running under what name and in what grouping as the new election laws has had the making for strange bedfellows. Who will combine with whom and how they divide up their lists is the kind of minutia which makes this boring to all but the most invested and the people who live politics. Are There Any Zionists in the Prime Minister’s Cabinet?

 

The shock after Naftali Bennett boldly proclaimed that the Jewish Home Party he heads was going to go forward with the proposed annexation of Maaleh Adumim, a city of 40,000 residents just east of Jerusalem, unless Prime Minister gave him personal assurances and a detailed plan for the annexation of Judea and Samaria and security progress going forward; was that he once again fell for merely making a plea to Bibi to stroke him with kind words and warm promises which will freeze to death in the hard realities of world politics and expediency. If Minister of the Knesset Bennett received such a plan, could he at least inform the members of his party of such a plan or is the plan so secret that the Prime Minister made him promise not to say a word or even hint at the grand and wondrous plan which he must have had laid out for him as the Security Cabinet voted unanimously to delay discussion on any law annexing Maaleh Adumim. Not a single dissenting vote was cast and the agreement was to push any further discussion until some point after Prime Minister meets with President Trump some time in February. That is February allowing a month of opportunity to pass by and these opportunities will never be regained. I actually know people in the Jewish Home Party and when I asked them what they knew it turned out they knew exactly what I know or less. None had heard of any grand plan to annex any part of Judea and Samaria. Everyone from any political party and my fellow Zionists and the members of the two Synagogues I attend daily all have not heard of any grand plan and many had heard that Bibi was still stuck with pushing the Two State Solution.

 

Their impressions were that Bibi was so invested and so many of his advisors are afraid that if they attempt to annex any part of Judea and Samaria that Mahmoud Abbas might pack up and drop the entire mess into our hands while Hamas and Islamic Jihad, aided by the Iranian Revolutionary Guard Corps (IRGC), attempt to also take control of Judea and Samaria. The best of their knowledge was that despite the massive shift and change in Washington D.C., the political elite in Israel still are fearful that they will be barred from visiting European nations or traveling places for vacation should they take definitive steps to annex any part of Judea and Samaria. They fear that they will no longer be able to shop in Paris, party along the French and Italian Riviera, attend conferences of inter-religious relations in Rome, ride the world’s tallest ferris wheel in London while visiting with the Queen, be able to ski the Swiss Alps, attend those elite cocktail and wine parties along rive gauche, those penthouse shindigs in Hollywood and Los Angeles and San Fran as well as the all-important New York, be able to talk before the General Assembly each fall at the opening ceremonies, be thrown out of the United Nations along with all the other organizations or simply no longer be amongst the beautiful people of our elitist world full of snobbish, secretive anti-Semites who deny Israel the rights granted under International Law because the Jews should not have their own nations as they are supposed to serve their betters around the globe and be thrown from the nation blamed for any ills absolving the leadership or any responsibility. The fact that Jews defend their own lands allowing them to act as if they are the equals of other nations thus making their own laws and running their own society actually offends these elites. They are the pretty people who have friends who are Jewish thus cannot be anti-Semites. They do not mention that their Jewish friends are polite Jews who know their place and act as they are expected and would never support Israel annexing Judea and Samaria. These good Jews do not support the Netanyahu government as he is so reactionary, right wing, conservative and possibly Zionist. They will lower themselves to allow some of these Israeli politicians and the elite of Israel society to visit and attend their parties as long as Israel behaves as they believe it should. Are these the people who are now influencing Israeli political decisions along with those loving Europeans who are joining BDS Movement one after the other but still will allow those certain Israelis to enter their country to visit as long as they behave properly and not do anything too offensive such as annex any parts of Judea, Samaria or Jerusalem. Somebody forgot to tell them that Israel already annexed East Jerusalem, so that bridge was crossed and will not be uncrossed despite European and other efforts to undo the annexation and award East Jerusalem to the Arab Palestinian terrorists despite knowing what will result. One can only believe that it is their desire to remove the Jews from their holy sites and make large areas of Jerusalem back into war zones. This reasoning also explains the UNESCO ruling that the Temple Mount and Kotel are Islamic with no history or relevance to Judaism or Christianity. It is the entirety of Judeo-Christian ethos and history which is under assault by the Western secular socialist elites who are embarrassed with their roots and historic past and are willing to tear down Western civilization and side with the barbarians promoting the most base cruelties which pervade Islamo-Facist Extremism.

What is disheartening about this Security Cabinet vote is it once again has proven the this “most right wing government in Israeli history,” as John Kerry and President Obama often referred to the Netanyahu headed coalitions as was a favorite description used by the mainstream media, has once again proven that it is the most craven government with the backbone of a jellyfish and just as toxic with its stinging rebuke of the very Zionism they claim to uphold. Rather than actually represent the religious Zionists which they are often accused of doing, this government led by Netanyahu has again stabbed the religious Zionists in their heart and their back by claiming the time is not right for any definitive actions such as annexing even the smallest of areas as it will inflame the world. Look around at the cities and areas across Europe rushing to boycott Israeli goods and perhaps you will realize the world is already inflamed with Israel even existing, they cannot be made any more inflamed and there is actually nothing to lose. As long as we are to be hated and the world will attempt to destroy us when we show weakness and fear, why not try boldness and firm reliance on our rights to the lands Hashem promised us, the Promised Lands, remember them? If we are going to go down in flames while being accused of being imperialist colonizers, can we at least act like one? These are our lands by every agreement made since we conquered these lands before London and Paris were more than small towns with dirt streets.

 

If we are to be hated, let it be for the right reason, let it be for religious by following Torah and inhabiting the lands, let it be for being Zionists and developing the lands, let it be that we stand proud and claim we are home to stay and are not the sniveling cowards hiding from every mean-spirited word or accusation. As trying to acquiesce to every demand and making every sacrifice demanded of us has led us to this juncture where we face looming isolation with our industries boycotted and demands for our extinction following one after the other, how about throwing out the playbook that we have been using for the past twenty or thirty years and try a different playbook. Here is an idea, let us use Torah as our guide on how to make friends and influence people. It tells us to walk boldly and confident in our lands and to guard the gifts that Hashem gave us with all our might. We are told to be proud and lead the world by example and not to hunker down until the time is right, the time will never be more right than it is right now. This is the right time. The new United States Administration, their new President, Donald Trump, and everything that they have done and shown has been a green light for Israel to end the sabotage which was laid upon our necks with the intended result to be the death of our state and the subjugation or murder of every Jews living in the world. What does our esteemed leadership think would happen to every Jew in Europe if there were no Israel today? If your picture is of a wonderful blooming of Jewish society accepted throughout Europe and the world if only we had never demanded and taken back our ancestral homeland, then you are sorely mistaken. If not for Israel the Europeans would be torn between forcing us from one town to the next always in a panic with a packed suitcase always by the door or simply herding us again to finish what was started by the Inquisitions, the Purifications and the Reformations all of which cast the Jew as the bane of society and a contaminant to be exterminated as vermin. That option no longer exists because at the first hint of such the Jews would flee to Israel and simply make Israel stronger. That is why their target is Israel; they cannot exterminate the Jews as long as they have a place of safe refuge. Do not perform this evil for those who would cast us into pits and bury us alive just to hear the muffled screams fade into silence and then rejoice. Annex all of Judea and Samaria now, cast the Palestinian Authority, Fatah, and every last terror related individual from within our shores and begin to give the Arabs who have been victims of the terror masters we allow to curse their daily lives a chance to experience life and not death. Let our being a light unto the nations start by being the beacon we must be for our own people. Act now and we are willing to bet that the nations of the world will sit up and take notice and will condemn us and make every threat available to them because they will be filled with fear and will attempt to push us back into that shrinking border they have envisioned for our eventual elimination. Once they realize they have lost that fight, then they will start to find some way of existing with the eventuality that Israel, her people and their leadership mean to remain a full member and equal amongst states in this world and that we are no longer those Jews who flee when a car backfired or a truck hits a large pothole because we are fearful of any loud noise. We must make the loud noise if we are to remain a viable and respected member amongst the nations. Read Torah and the rest of our Bible and it becomes obvious, the only times we were allowed to reside here in peace was when we were strong and the nations feared to anger us. When we were weak of will they conquered and enslaved and even attempted to exterminate us. Choose life. Choose strength. Choose to be the true saviors of Eretz Yisroel and make the full map of Israel that pictured above, anything less is a capitulation to anti-Semitism and agreement with the argument that Israel is a false state with no rights to exist. Either we have the rights to every millimeter of land west of the Jordan River or we have no right to any of the lands west of the Jordan River, there is no compromise. Acquiescing to allow another division of our lands is tantamount to agreeing that any claim to any lands are subject to the acceptance by our enemies and we are so afraid of our enemies who are so many and so strong that we will cower and take whatever morsel we are permitted by those enemies. Believe us when we inform you that our enemies do not plan on allowing us any land whatsoever. If we are to have any lands here in our ancestral homelands, then we will have to stand up for ourselves and proudly proclaim, “Am Yisroel Chai,” and with that ringing in our ears as well as those of our enemies, we must then proceed to claim what is rightfully ours. Weakness is how Jordanian-occupied Jewish lands became Arab lands for a new Arab State simply because when we offered to return the occupied lands to Jordan we signaled we were not interested in reclaiming our own land and that by inference we would not stand and defend any of our land, make us and the world realize that was then and this is now and now we are claiming every inch of our holy and precious lands and the world can go spit in the ocean if this unsettles them.
